Terms of Service

ClearLoads is a digital wellness and self-observation tool for tracking mental load through 10-second check-ins. The service provides micro-actions and visualizations based on psychology and neuroscience research. ClearLoads is NOT: • A medical device under EU Regulation 2017/745 or equivalent • A substitute for professional mental health care • A clinical diagnostic tool ClearLoads is available through Free and Premium plans as described below.

By accessing ClearLoads or creating an account, you accept these Terms in full. If you do not accept these Terms, you must not use the service.

Free Plan: 0 CAD. Features: unlimited check-ins, 7-day history, 15 micro-actions, visual mirror. Forever, no credit card. Premium Plan: 99 CAD/year (≈ $8.25/month) or 12 CAD/month. Features: unlimited history, 400+ actions, AI trends, PDF export, burnout alerts, priority support. Premium Trial: 7 days free. No charge for 7 days. Cancel anytime before trial end = guaranteed $0 charged. Email reminder sent 48h before expiration. Money-back guarantee: full refund within 30 days of first effective charge, no conditions. Minimum age: 16 years. By creating an account, you confirm you meet the age requirement. Authentication: ClearLoads uses magic links sent by email. You are responsible for your email security. One account per person. Sharing accounts or creating multiple accounts to circumvent restrictions is prohibited. ClearLoads reserves the right to suspend or delete accounts for: violation of these Terms, fraudulent use, non-payment (Premium plan). A 7-day notice is given except for serious violations (fraud, security breach, illegal content).

ClearLoads rights: all service content (texts, scoring algorithms, design, source code, "ClearLoads" trademark, micro-action library) is protected by Canadian and international copyright. No reproduction or commercial use is permitted without prior written agreement. User rights: your check-in data belongs to you. ClearLoads has a limited, non-exclusive, non-transferable license to process this data solely to provide the service. This license ends when you delete your account. Generated content: insights and visualizations generated by ClearLoads are for informational purposes only. You may share them personally (e.g., with your doctor) but not for commercial purposes without prior agreement.

By using ClearLoads, you agree to: • Provide accurate information when creating your account • Not attempt to circumvent security measures • Not use the service for unlawful purposes • Not automate service access (scraping, bots) • Not harm other users or the infrastructure • Respect ClearLoads intellectual property rights

ClearLoads targets 99.5% monthly uptime, measured from our monitoring servers. Exceptions: scheduled maintenance (announced 24h in advance), force majeure, third-party provider failures (Supabase, Stripe). For unplanned outages exceeding 24 consecutive hours, Premium subscribers receive a proportional service credit applied to the next billing cycle.

ClearLoads is provided "as is" and "as available." To the extent permitted by applicable law: • ClearLoads shall not be liable for direct, indirect, incidental, consequential, or punitive damages resulting from use or inability to use the service. • ClearLoads total liability shall not exceed the amounts paid by the user in the last 12 months. • ClearLoads does not guarantee the accuracy or completeness of micro-actions or insights provided. Some jurisdictions do not allow certain damage exclusions. These limitations apply to the extent permitted by law.

ClearLoads shall not be liable for any failure resulting from force majeure events, including without limitation: natural disasters, wars, terrorist acts, pandemics, widespread Internet failures, government actions, or any other unforeseeable and irresistible event beyond ClearLoads' reasonable control. In case of force majeure lasting more than 30 days, Premium subscribers may request termination with pro-rata refund.

By user: you may cancel your Premium subscription at any time from Dashboard → Settings → Cancel subscription. Cancellation takes effect at the end of the current period. You retain Premium access until that date. To delete your account: Dashboard → Settings → Delete my account. By ClearLoads: ClearLoads may terminate access for Terms violations, with 7 days' notice (except serious violations). For terminations initiated by ClearLoads without valid reason, a pro-rata refund will be provided.

ClearLoads may modify these Terms. For substantial changes (price changes, feature limitations, liability changes), you will receive email notification with 30 days' notice. If changes are substantially adverse, you may cancel before the effective date and receive a pro-rata refund.

These Terms are governed by Canadian law, specifically Quebec law. Pre-litigation mediation: before any legal action, parties agree to attempt amicable resolution within 30 days of dispute notification. Jurisdiction: unresolved disputes are subject to the competent courts of Quebec, Canada. EU consumers: the EU Online Dispute Resolution platform is available at: ec.europa.eu/consumers/odr

Severability: if any provision is found invalid, the remaining provisions continue in effect. No waiver: ClearLoads' failure to exercise any right does not constitute a waiver of that right. Entire agreement: these Terms constitute the entire agreement between user and ClearLoads regarding use of the service.
